Cancellation & Refund Policy Especially for Land & Train Tours
In case of cancellation of tour/travel services due to any avoidable/unavoidable reason/s we must be informed in writing. Cancellation charges would be effective from the date we receive letter in writing and cancellation charges would be as follows:

Until 90 days prior to arrival – 30% of the deposited amount
Between 89 days to 60 days prior to arrival – 40% of the deposited amount
Between 59 days to 0 days prior to arrival – NO REFUND

Note:-

Irrespective of above-mentioned cancellation slabs, in case of cancellation of tour / travel services (due to whatsoever reason) by yourself (by client) after the booking is made with us – a minimum 30% service charge would be applicable on total cost of the tour package.

Irrespective of above-mentioned cancellation slabs, in case of cancellation of tour / travel services (due to whatsoever reason) by us (by company) after the booking is made by us – Following two options are available:

Client would be provided with Credit Note for the booking amount paid and same can be used anytime in the future by the client for themselves or any of their family members, friends, or anyone else as recommended by them.

In case the client wants the refund – then a minimum 30% service charge would be applicable on the total cost of the tour package and remaining amount (after deducting this 30% service charge) would be refunded.

In above both the situation – the cancellation charges, as applicable for cancellation of services related to tickets/ hotel bookings/ travel services/ Guide services would also be recovered from the client.

In case you cancel your trip after commencement the refund would be restricted to a limited amount that would depend on the amount that we would be able to recover from the hoteliers, airlines, transporter and other suppliers we patronize. For unused hotel accommodation, flight tickets, transportation, missed meals and any other services etc. we do not bear any responsibility to refund.

Please note that if booking for following period is/are cancelled, due to whatsoever reason, no refund would be made for said cancellation.

Festival Period Bookings (Festivals like – Diwali, Dussehra, Holi, Pushkar fair etc).
High Peak Season bookings (from 20th Dec to 15th Jan).
Long Weekends Bookings.

Cancellation amount is calculated as per total booking amount and not as per advance deposited

Refund:

In regard to refund of unused / unutilized services (which are paid for and cancelled in advance) the refund amount would be worked out on the basis of cancellation policy as described above and the money would be accordingly refunded to the person who has made the payment to us. Please note that the refund process may take 2 – 4 weeks due to banking procedures. If the refund is made to the credit card account OR to Bank account, the bank charges would be debited from the refund amount.

Terms and conditions for making reservation in cruise with land tour
At travel n tours India, we want to do everything we can to make sure your trip is enjoyable and worry-free. As part of that commitment, we are including the following terms and conditions for your trip with us. By confirming the reservation with payment, the guest/travel agent acknowledges that they are aware of and will comply with these terms and conditions. We reserve the right to change our terms and conditions.

MAKING A RESERVATION FOR CRUISE WITH LAND TOURS

Reserving or participating in any travel services offered by travel n tours India. (hereinafter “The Company”, “we”, “us”) constitutes a contractual agreement between the participant (“you”) and The Company and is an acknowledgement that you have read, understand, and agree to be bound by these Terms & Conditions (“Terms”). You must be at least 18 years of age to make a reservation. In all cases, the person making the reservation represents and warrants that all participants have consented to, accepted, and agreed to be bound by these Terms.
The Company reserves the right to update or amend these Terms at any time prior to you making a reservation. The Terms as listed online when completing a reservation are those that will prevail.
Any payment made to The Company shall be deemed to constitute full acceptance of these Terms.

Deposits, Payments, Confirmation & Invoicing

Pricing
Our prices are indicated on a per person basis and based on a double cabin. They are established on the basis of the prevailing economic conditions and are calculated at an all-in rate including a series of service provisions described in the programmes and reserved by the customer but exclude all service provisions that the customer shall have to pay for expenses onboard and other costs and any expenditure occasioned by a fortuitous event (strike, riot, revolution, weather conditions, water levels, etc.).
They depend on various factors involved in their calculation such as the cost of transportation, port costs, fuel costs, royalties and other taxes, and remain subject to revision. Should fuel cost rise by more than 10% over those obtaining at the time of publishing the yearly tariff, The Company may impose fuel surcharge to cover the extra cost.
Pricing for our cruise departures is subject to change at any time prior to receipt of full deposit. Once The Company processes any payment for services, the price is guaranteed not to increase unless you amend your reservation. In any case, no price change can be made in the 20 days preceding the departure.
All services charged onboard the boats should be paid on board, before disembarkation from the ship by clients.

Deposit to hold space
At the time of reservation, a non-transferable, non-refundable per person deposit is required.
The deposit amount is dependent upon the cruise departure booked and applicable price of that departure as displayed in our website and quoted to you.

Full payment
Full payment is required by the final payment date. The final payment date is determined using the section “Deposit Amounts, Final Payment Dates & Cancellation Fee Schedules” below.
If you do not pay the full invoice by the final payment date, your reservation and all services on the reservation will be cancelled, and your deposit will be forfeited.
Reservations made after the final payment date require full payment at the time of reservation.

Ways to pay
The Company accepts payment via Banking Wire Transfer, Visa and Master Card.

Confirmation
Your reservation is confirmed when your initial deposit payment is processed. Your invoice, when documented as payment received, is confirmation of services on the reservation.

Accuracy of invoice details
You are responsible for providing and verifying full, complete and accurate information for all participants and services at the time of reservation. Under no circumstances is The Company liable for any errors or omissions in the information provided by you to complete the reservation. If you do not notify The Company of any error within 5 days of making the reservation, you are solely responsible for all fees assessed due to incomplete, erroneous or inaccurate details.

 

Billing errors
In the case of billing errors, The Company reserves the right to re-invoice you with correct pricing.
Deposit amount, Final payment dates, Cancellation fees schedule
Reservations can only be confirmed on receipt of a deposit of 30% of the total cost (or full payment if booking being done within 90 days of departure).
Final Payment is payable 90 days before departure. Failure to pay may be treated as a cancellation and our cancellation terms will apply.
The final payment date is determined on days prior to the commencement of services. We calculate cancellation fees based on the days prior to the commencement of services in which notification is received. Cancellation fees include all services on the river cruise reservation.

  • Until 90 days prior to arrival – 30% of the deposited
    Between 89 days to 65 days prior to arrival – 40% of the deposited
    Between 64 days to 0 days prior to arrival – NO REFUND

(Special, short-term booking offers might be announced by the Company from time to time, provisions of which will be laid down along with the offer)

‘Not included’ pricing

  • Unless specifically noted in your trip itinerary, the following is not included in your reservation.
  • Airfare to and from the start of your trip
  • Airline baggage fees, including checked and/or excess baggage fees
  • International Air Transportation tax
  • Other per-person taxes imposed by government entities
  • Airport taxes and fees
  • Vaccinations
  • Any gratuities
  • Laundry; telephone; mini-bar
  • Spa Services
  • Entry/exit fees at airports
  • Alcoholic beverages, chargeable beverages, Food outside of the cruise package (these extra items will be billed to you before leaving the ship)
  • Any Insurance
  • Goods and Services Tax (GST)

The client warrants that at the time of booking, he is not travelling contrary to the advice of his own national Ministry of Foreign Affairs. Should that advice have subsequently changed to a definite recommendation against travelling for leisure purposes, and should the altered advice still be current 10 days or less before departure, then Travel n tours India will credit all money paid towards a later booking, to be taken within 24 months of the initial departure date. Where the client has initially booked contrary to the recommendations of his/her own government and subsequently decides to cancel, our normal cancellation conditions apply.

CANCELLATIONS
Participant cancellations
You may cancel your reservation by notifying The Company. Calculation of cancellation amounts includes all services and fees on the invoice based on the number of days prior to departure by which we receive the notification. See the “Deposit Amounts, Final Payment Dates & Cancellation Fee Schedules” above.

Cancellations by the company
The Company reserves the right to cancel or reschedule any trip departure for any reason, including insufficient demand, strikes, lockouts, riots, stoppage of labour or Force Majeure Event (see under “Force Majeure”).

In the event of a cancellation by The Company prior to departure, The Company will try, at your discretion, to rebook the same trip with a different departure date or a similar trip, but there is no guarantee of availability. The Company will refund or issue a credit note for the difference in price if the alternate departure date is at a lower price. You are responsible for an additional cost if the alternate departure date is at a higher price. If this rebooking option is not acceptable to you, The Company‟s only responsibility is to refund the amounts paid by you for the reservation.

In the event of a cancellation by The Company prior to departure or during your trip for conditions under Force Majeure, The Company will provide a future travel/booking credit note for the portion of your trip impacted. Future travel/booking credit note will be redeemable for travel with The Company for one year past your original trip start date. If a future travel/booking credit note is not acceptable to you, in the majority of Force Majeure situations, you can notify the company within 21 days of advisement and The Company‟s only responsibility is to refund the amounts paid by you for the portion of your trip impacted. If you do not notify the Company within 21 days of advisement, a refund is no longer available.

The Company is not liable or responsible for any arrangements made independently of The Company. The Company assumes no responsibility for costs or fees you incur for independent arrangements not booked through The Company, inclusive of, but not limited to, airline, hotel, transfers, excursion and any other travel arrangements.

REFUNDS
Any request for refunds is subject to these terms:

Airport transfers
Airport group transfers (as specified) are complimentary for cabins booked on our cruise departures booked through The Company. No cash equivalent or trip price reduction is given if you do not use, or desire, the included transfers.

Unused services
No refunds will be issued for unused services (late arrivals, temporary absences from your cruise or early departures), meals not taken, group transfers, for unused
transportation where group activity is involved, or for voluntary decision of withdrawal from group activity or group excursions made by you.

‘Subject to change’ itineraries
All Cruise Departures are advertised with „subject to change in itinerary‟.

The Company will notify you via email if a change in itinerary is foreseen before the start of the cruise departure.

FORCE MAJEURE
In the event of a Force Majeure Event (as defined below), The Company shall be excused, discharged, and released from performance to the extent such performance is so limited or prevented, without liability of any kind.

  • The Company assumes no liability for any loss or damage of any nature in whole or in part resulting from an “Act of God” or any other condition outside The Company‟s control (“Force Majeure Event”), including without limitation:
  • Fire
  • Volcanic eruption
  • Inclement weather
  • Environmental pollution or contamination
  • Earthquake
  • Low or high water levels
  • Flood
  • Water or power shortages or failures
  • Tropical storms or hurricanes
  • Riots or civil commissions or disturbances or any other acts of similar nature
  • Sabotage
  • Strikes or labour disruptions
  • Arrests
  • Restraint of rulers or peoples
  • Expropriations
  • Acts of terrorism
  • War
  • Insurrection
  • Quarantine restrictions
  • Government health advisories or warnings or alerts of any kind of nature
  • Government seizures
  • Refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization
  • Damages to its facilities or the travel supplier and its facilities
  • Or any other unforeseen circumstances or any other factors unforeseen by the Company that adversely affects or hampers its ability to fulfil any of its contractual conditions.

REQUIREMENTS FOR PARTICIPATION
Any special requirements or disabilities must be disclosed to The Company at the time of reservation, or if such requirements arise after the reservation, as soon as such requirements are or reasonably should be known by the participant. If The Company has
not received disclosure of requirements or disabilities that require reasonable accommodations for accessibility, and/or if your participation poses a threat to the safety or health to self or others, The Company may be unable to accommodate you for the entire Cruise or any services provided in connection with the Cruise itinerary.

SUITABILITY & ACCESSIBILITY
Certain activities or venues may be limited or inaccessible to you if your mobility is limited in any manner. Many excursions and sightseeing involves extended periods of walking and standing, often on uneven surfaces, and may include staircases, paths, walkways, etc.

You are responsible for assessing if the itinerary is suitable for all participants on the reservation. We recommend you contact The Company prior to making a reservation to determine what reasonable assistance might be available.

The Company will make reasonable efforts to accommodate special needs but cannot guarantee that it can accommodate in all cases.

No refunds are provided for missed services or activities due to your inability to fully participate with the group, including keeping the pace with the group, if conditions requiring assistance are not known to The Company at the time of reservation or when reasonably known by the participant.

PERSONAL SERVICES
The Company does not provide personal services or individual assistants to trip participants. Our staff are not required or trained to assist with personal tasks. This includes eating, dressing, toileting, lifting or pushing a wheelchair, walking, getting on or off transportation, or other personal needs. If you need such assistance, we strongly recommend you have a physically-able companion accompany you.

AUTHORITY TO REMOVE OR REFUSE PARTICIPANTS


In the sole discretion of The Company or the Cruise Manager or the Master of the vessel, The Company may refuse accommodation to you or may require you to disembark if it is reasonably believed that you are dangerous to others or to yourself; or are threatening to engage in behaviour that may adversely affect the safety, security, comfort, enjoyment, or well-being of other participants, The Company representatives, or crew members, including, but not limited to, behaviour that is disruptive, verbally abusive, physically abusive, obnoxious, harassing, discriminatory, or obscene; have failed or refused to follow, or are failing or refusing to follow The Company’s rules and procedures or the instructions of The Company representatives.
In the event you are removed, you may be left at any city, port or place the ship calls without any liability to The Company or its representatives. The Company shall not be required to refund any portion of the fare paid by you if you are removed pursuant to this section.

In the event you are removed, The Company will not be responsible for expenses for lodging, medical care, meals, transportation, or any other expenses incurred by you. We shall be entitled to recover from you any costs or expenses incurred by The Company, its representatives, or the crew members in your removal or the exercise or enforcement of this clause.

INFORMATION REQUIRED FOR RESERVATION & TRAVEL

As a condition of reservation, you must provide the information requested by The Company along with your initial payment. The Company reserves the right to cancel your reservation and all services, and retain all related cancellation fees if your information is incomplete or inaccurate. Your personal data collected for your reservation is used to process your services. This may include requirements to pass details to certain government-appointed bodies, or agencies in the interest of security or because we are obliged to by law.

After the final payment date
Any change to a participant’s name, trip date, or itinerary after the final payment date is treated as a full cancellation and new reservation. All cancellation fees apply in these instances.

Any dispute arising out of this contract will be governed by Indian law under the Delhi High Court jurisdiction.
